Aaron Constant reserves the right to use material created on assignment or project for self promotion purposes only in electronic and/or print media form. Images will not be licensed for commercial use in any way.

Payment Terms for commercial projects are Net 10 days. Beyond Net 10 a finance charge of 1-1/2% per day will be incurred. Deposits are required on material purchases and expenses, otherwise they will be invoiced at cost plus 15%. Consumer projects, stock image licenses and fine art prints are COD.

Model / Property Releases for commercial and assignment work are the responsibility of The Buyer. In the event Aaron is securing talent or location, Aaron Constant will provide the necessary releases.

Insurance can be provided for additionally insured parties. Please notify Aaron in advance if your needs require a COI (Certificate of Insurance). Aaron will need the name and address of your party and will have his agent fax a copy of the COI for your records. Aaron's services are additionally covered for loss or damage.

Turn around times on files are 48 hours after the shoot. Photographer Selects and projects where retouching and color correcting are requested, delivery will be determined. For expedited services, please let Aaron know in advance. Contact Prints are provided with all disks and invoiced accordingly.

File handling is something Aaron take very serious. Images from all shoots are backed up on location to portable storage devices, then immediately backed up in studio to (2) CD/DVDs and external hard drives. However, until images can be downloaded and saved to disk successfully, they are in a fragile state. Being electronic media, memory cards or files themselves can become corrupt or accidentally deleted without warning. Aaron's policy states that if more than 50% of the images are lost or corrupt, his libility ends at the cost of services for that shoot only, resulting in a refund or no charge to the client, or a reshoot can be re-scheduled. Aaron is not liable for your expenses.

Image delivery. Due to the many color management and output devices in today's technological market, Aaron's standard is to provide all images unedited as RGB / DNG files. If RGB conversions are requested, they will be assigned Adobe RGB (1998) and delivered unedtied. Aaron is more than happy to provide images in any format a client requires. In the event you require this service, standard conversions are charged on a per image price.

Pricing (how I charge). Art, copy, food, product and portrait assignments are priced per image from the price list. Mileage, tolls and expenses are charged as additional and itemized accordingly.

Assignments. Advertising, Corporate, Commercial, Editorial or freelance assignments are charged by a half day or full day rate. One half day is considered 4 hours and a full day is considered 5 hours up to 10 hours total. Rates include the creative fee, capture and equipment usage on the day of the shoot. Additional items such as talent/location scouting, retouching etc. are billed as additional, but will be included on your estimate.

Licensing. Editorial assignment fees include a One Time, First North American Publication Rights license valid for the first use limited to one year. Commercial assignments include licensing rights for the inteded purpose of the shoot only. Additional uses and rights available and will be negotiated prior to licensing. Applicable fees for licensing are priced as additional based on usage, quantity and duration of use. Aaron provides all clients with usage estimates prior to the assignment.

All projects are delivered via ftp or CD/DVD containing all hi resolution images and contact prints of the contents on the CD/DVD. Aaron does charge for these items, but feels it is critical to have a contact print backup of your files, but it is less expensive to have us create them before delivery than after.
